Portugal Fiberglass provides a range of services, which may be subject to additional terms. When you use any Portugal Fiberglass service, you are also subject to the applicable guidelines, terms, and conditions. In case of any inconsistency, these Terms and Conditions will prevail.

1. Objective These terms and conditions outline the sales modalities between Portugal Fiberglass and its customers. For the purposes of these Terms and Conditions, a customer is defined as any individual or entity placing an order on the website www.portugal-fiberglass.com, whether a private consumer or not.

1.1 Territorial Scope Customers making purchases via Portugal Fiberglass’s online store are subject to Portuguese law. In the event of a dispute, both parties will prioritize finding an amicable solution.

1.4 Product Characteristics Portugal Fiberglass endeavors to provide accurate technical specifications and essential characteristics of products. The company is not liable for incorrect data provided by suppliers. While we strive to ensure that product images on our store accurately represent the items, any aesthetic differences will not affect the product’s characteristics. Unless otherwise specified, all products sold by Portugal Fiberglass are new. The products comply with the laws and standards applicable in Portugal. Portugal Fiberglass aims to provide user manuals in the consumer’s language whenever possible. However, in some cases, the manual may only be available in digital format.

1.5 Discounts, Promotions, and Offers Offers are made based on the purchased product and are indicated on the product pages. The customer cannot claim any discount or compensation. These offers, discounts, or promotions are not guaranteed, and returns or exchanges of such items will not be accepted.

1.6 Pricing 1.6.1 Prices listed on www.portugal-fiberglass.com are in Euros. 1.6.2 Prices are subject to change at any time. Prices for products not in stock, pre-orders, or those labeled as “coming soon” may change after the order is submitted. Once the product is in stock, the customer will be informed of any price changes and will have the option to cancel the order. 1.6.3 All prices are subject to typographical errors. 1.6.4 All shipped orders include insurance, the cost of which is included in the price.

2. Taxes All prices displayed include applicable taxes and fees.

3. Orders 3.1 Order Placement Private customers can place orders directly through www.portugal-fiberglass.com. This process involves filling out the provided form, validating the order, and making the payment. Portugal Fiberglass is not responsible for email delivery errors or shipping errors due to incorrect form submissions. The customer is responsible for all information provided during the order process, which will be used for billing and shipping. The customer will be informed via email of the order status, provided the email address is correct.

3.2 Order Cancellation Customers can cancel their order only if it has not yet been invoiced. Once invoiced, no refunds will be issued.

3.3 Product Availability If Portugal Fiberglass is unable to source a product from its suppliers, the customer will be notified via email about the order status. The customer may then choose to cancel the order or select an alternative product offered by Portugal Fiberglass.

4. Payment 4.1 Payment Methods Customers may pay using the following methods: 4.1.1 Authorized credit cards (VISA or MasterCard) with exchange rates applied at the customer’s expense. 4.1.2 Bank transfer. 4.1.3 American Express. 4.1.4 PayPal. Payments via PayPal will be processed in Euros, with exchange rates applied at the customer’s expense. The policy of MasterCard and Visa requires choosing between their currency conversion process or PayPal’s. If PayPal is selected for conversion, MasterCard or Visa cannot be held responsible for any issues related to the conversion. Conversely, if MasterCard or Visa is selected, PayPal cannot be held responsible. 4.1.5 Multibanco Reference: This payment method is simple, secure, and reliable, allowing for bank transfers, ATM payments, or “homebanking” through the financial institution. A key advantage is the ability to pay 24 hours a day, with the amount being directly deducted from the bank account. A “reference” code and “entity” code will be provided for payment. 4.1.6 MB Way Payment: MB Way is an application offering an interbank solution for immediate purchases and transfers via smartphone or tablet. To use it, associate a bank card with a mobile number at an ATM and create a six-digit PIN. After downloading the app, activate the service on your device, and it’s ready to use. When ordering from Portugal Fiberglass using MB Way, you will receive a payment request notification in the “Activities” section of the app. The transaction amount and the payment institution managing the transaction—ifThenPay—will be visible. You have four minutes to accept or decline the transaction. Upon acceptance, enter your six-digit PIN, and the payment will be processed immediately. At this point, Portugal Fiberglass will register your purchase and begin processing your order for shipment.

4.2 Non-Payment Portugal Fiberglass and its associated entities reserve the right to refuse delivery or fulfill an order if payment is not made.

4.3 Anti-Fraud Control Customer order information is verified for potential credit card or PayPal fraud. Portugal Fiberglass is the recipient of order-related data, and all processes related to www.portugal-fiberglass.com. Failure to provide accurate data or missing information may prevent the transaction from being completed or analyzed.

4.4 Retention of Ownership Portugal Fiberglass retains ownership of the goods until payment is made in full.

5. Invoicing The customer will receive their invoice via email in accordance with the order shipment and the information provided on the form or with the order. Portugal Fiberglass reserves the right to deliver the invoice by other means.

6. Timeframes 6.1 Preparation Timeframes Orders placed through www.portugal-fiberglass.com are processed in the order they are received, Monday through Friday. The processing time varies depending on the payment method chosen by the customer and confirmation of payment receipt. Processing time can range from minutes to several days.

6.2 Shipping Timeframes The estimated shipping times provided by the carrier are communicated to the customer. However, these depend on the accuracy of the address and availability for receipt. Delays caused by the carrier cannot compromise or hold Portugal Fiberglass responsible. These timeframes are merely estimates and may be subject to delays for reasons beyond the company’s control.

6.3 Delivery Timeframes Delivery times may vary depending on the product type, payment method, and carrier. The customer will be informed of the order status and may inquire with Portugal Fiberglass at any time. Portugal Fiberglass does not issue refunds for delays in delivery.

7. Delivery 7.1 Delivery Location Orders are delivered to the address provided by the customer. Portugal Fiberglass is not responsible for incorrect address information and any resulting delays.

7.2 Absence on Delivery Day Depending on the situation, the carrier may attempt to contact the customer at the time of delivery, or in case of absence, return to attempt delivery again. If delivery is still not possible, the order will be returned to the headquarters, warehouse, or another address designated by Portugal Fiberglass to the carrier. The customer will then need to arrange to pick up the order or pay for another delivery attempt. The cost varies depending on the order type.

7.3 Delivery Delays In cases of significant delays, it is the customer’s responsibility to track the delivery status. This can be done via the carrier’s support line or website. No refunds will be issued for delayed deliveries.

7.4 Lost Orders In the event of a lost order during delivery, the company reserves the right to activate insurance, notify the carrier, and await reimbursement. The customer must also await the conclusion of this process.

7.5 Order Receipt All orders are delivered by hand and require the recipient’s signature as proof of delivery. The customer must verify that the goods received are correct, complete, and intact.

All orders should be inspected for potential partial or total damage. If any damage is found, it must be noted on the delivery slip. Non-personalized products delivered with damage may be returned at no additional cost. Returns will only be accepted as “damaged” if noted on the delivery slip. The customer is responsible for verifying the condition of the goods upon receipt. Without reservations, the order will be considered delivered and no complaints will be accepted by Portugal Fiberglass. However, the recipient may file a complaint against the carrier within 48 hours of delivery.

Required Documents for Complaints or Transportation Damage

• A brief description of the problem and a detailed description of the damage, including photos of the affected areas/defects (as detailed as possible), photos of the complete product, and photos of the packaging in which the products were delivered (including box damage and a photo where the part number and order number are visible).
• For transportation damage: A copy of the delivery receipt indicating the condition of the goods at the time of delivery, signed by the courier. If the driver acknowledged the damage electronically, we request confirmation that the shipment was marked as damaged.
• In the event of transportation damage, Portugal Fiberglass must be notified immediately.

Required Photos:

1. A close-up of the damaged area.
2. A detailed shot of the damage.
3. A picture of the entire item, including the damaged area.
4. A picture of the package in which the damaged item was delivered.
5. A picture of the package where the part number and order number are visible.

7.6 Right of Withdrawal In accordance with the relevant legal provisions, consumers have 14 days to withdraw from a purchase. However, the right of withdrawal does not apply to personalized or custom-made products.

The request for withdrawal should be submitted by email. The product must be returned in its original packaging, unused, and with all accessories. Return costs are borne by the customer.

The right of withdrawal is not valid if the product has been used, assembled, or damaged by the customer. The refund, excluding shipping costs, will be processed within 14 days of receiving the returned item in its original condition.

7.7 Legal Warranty Products purchased on Portugal Fiberglass are covered by a legal warranty in accordance with applicable law. In case of a defect, the customer must notify Portugal Fiberglass immediately.

7.8 Force Majeure Portugal Fiberglass cannot be held responsible for delays in delivery or order processing due to circumstances beyond its control, including, but not limited to, strikes, natural disasters, pandemics, or government actions.

11. Liability Portugal Fiberglass is not liable for any damages resulting from improper use of the products sold. The customer is responsible for ensuring that the product is suitable for their needs.  Portugal Fiberglass is released from its delivery obligations in cases of force majeure and cannot be held responsible for data loss. Portugal Fiberglass declines all liability for the misuse or improper use of products ordered by the customer. Products sold are generally covered by a contractual warranty provided exclusively by the manufacturer, as outlined in the warranty booklet included with the product and/or the manufacturer’s terms and conditions. If the customer is a professional or the goods are used entirely for professional purposes, Portugal Fiberglass cannot be held responsible for any consequences related to the use of these products within the scope of the customer’s business, whether directly or indirectly, for any reason. The total or partial inability to use the products, particularly due to material or software incompatibility, does not entitle the customer to any compensation, refund, or liability on the part of Portugal Fiberglass. The domain www.portugal-fiberglass.com is owned by Bruno André, located at Rua Tenente Raul Cascais 10 RC, 21 8 16 16 54. Websites linked directly or indirectly to Portugal Fiberglass’s sites, including portugal-fiberglass.com, its domain, and subdomains, are not under the company’s control.
